Strategic Litigation

The strategic litigation program has been a part of the OSF – Armenia since 2008. Within this program, the Foundation supports initiatives aimed at the protection of human rights and fundamental freedoms, as well as other issues concerning the public interest, by conducting litigation aimed at strategic effects. In this way, the Strategic Litigation program takes carefully selected cases to court in order to bring about changes in the law, practice or public awareness. As such, the strategic litigation program focuses on individual cases in order to bring about social change.

Within the Strategic Litigation program, the Foundation supports lawyers and organizations to take cases to domestic courts and bring cases to the European Court of Human Rights. The Foundation also supports advocacy around selected cases that tactically makes it more likely for judges to decide in applicants’ favour, and as a follow-through from successful (and unsuccessful) court judgments. The capacity-building component of the program supports strategic litigation actors by strengthening litigating skills and specific legal knowledge of attorneys and human rights defenders.
